Welcome to Panel 9 Music. These Terms of Service (“Terms”) govern your access to and use of the Panel 9 Music website, desktop application, music catalog, and related services (collectively, the “Service”). By creating an account, subscribing, downloading music, or using the Service, you agree to these Terms.
If you do not agree to these Terms, do not use the Service.
1. About Panel 9 Music
Panel 9 Music provides subscribers with access to a catalog of music tracks and related audio content for use in cheerleading mixes and performances.
Panel 9 Music grants limited, non-exclusive, non-transferable licenses to subscribers under the conditions described in these Terms.
2. Eligibility
You must be at least 18 years old or have permission from a parent, guardian, or authorized organization representative to use the Service.
If you are using the Service on behalf of a business, gym, school, or organization, you represent that you have authority to bind that entity to these Terms.
3. Subscription Access
Access to the music catalog requires an active paid subscription unless otherwise stated in writing by Panel 9 Music.
Your subscription grants you access to use eligible music during your active subscription period, subject to these Terms.
Panel 9 Music may modify subscription pricing, features, or available content at any time.
4. License Grant
Subject to an active subscription and compliance with these Terms, Panel 9 Music grants subscribers a limited, revocable, non-exclusive, non-transferable license to:
- Download and use music from the Panel 9 Music catalog in cheerleading mixes;
- Create custom mixes for cheerleading teams, gyms, coaches, or organizations;
- Sell or distribute those completed mixes to clients, including coaches, gyms, and teams;
- Permit teams to perform routines containing the licensed music at competitions, showcases, practices, exhibitions, and live events;
- Permit teams to livestream or broadcast performances that include the licensed music;
- Use completed mixes for a period of one (1) year from the date the mix is delivered to the client.
This license only applies to music obtained through an active Panel 9 Music subscription.
5. Subscription Requirement for License Validity
The license granted under these Terms remains valid only while the subscriber who created the mix maintains an active Panel 9 Music subscription.
If a subscriber cancels, fails to renew, or otherwise loses access to their subscription:
- The subscriber immediately loses the right to create new mixes using Panel 9 Music content;
- Existing licenses associated with mixes created by that subscriber will be revoked;
- Teams, coaches, and clients will lose the right to continue using mixes containing Panel 9 Music content unless otherwise approved in writing by Panel 9 Music.
Panel 9 Music reserves the right to determine continued eligibility for use of previously created mixes after subscription termination.
6. Restrictions
Except as expressly permitted in these Terms, users may not:
- Resell, redistribute, sublicense, share, or transfer standalone music tracks;
- Upload or distribute Panel 9 Music tracks to streaming platforms, public music libraries, or content marketplaces;
- Claim ownership of Panel 9 Music content;
- Use the music in television shows, films, advertisements, commercial music releases, or unrelated media productions without written permission;
- Use the Service or content in any unlawful, defamatory, infringing, or harmful manner;
- Circumvent subscription requirements, security systems, or licensing restrictions.
- Producers, editors, or subscribers may not use Panel 9 Music content to create, distribute, or sell pre-made, stock, template-based, or non-client-specific cheerleading mixes for resale, marketplace distribution, or mass licensing. All mixes created using Panel 9 Music content must be custom-made for a specific team, coach, gym, or client.
All rights not expressly granted are reserved by Panel 9 Music.
7. Ownership
All music, audio content, branding, software, artwork, logos, and intellectual property provided through the Service remain the property of Panel 9 Music and/or its licensors.
No ownership rights are transferred to subscribers or clients.
8. User Accounts
Users are responsible for maintaining the confidentiality of their account credentials and for all activity occurring under their account.
You agree to provide accurate information and to notify Panel 9 Music immediately of any unauthorized use of your account.
Panel 9 Music may suspend or terminate accounts that violate these Terms.
9. Payments and Billing
Subscriptions are billed on a recurring basis unless canceled.
All fees are non-refundable unless required by law or otherwise stated by Panel 9 Music.
Failure to pay subscription fees may result in suspension or termination of access and associated licensing rights.
10. DMCA and Copyright Complaints
Panel 9 Music respects intellectual property rights.
If you believe content available through the Service infringes your copyright, please contact Panel 9 Music with sufficient information to investigate the claim.
11. Disclaimer of Warranties
The Service and all content are provided “as is” and “as available.”
Panel 9 Music makes no warranties regarding uninterrupted availability, error-free operation, or fitness for a particular purpose.
Panel 9 Music does not guarantee that third-party platforms, livestream providers, social media platforms, or competition organizations will not mute, block, or restrict content containing licensed music.
12. Limitation of Liability
To the maximum extent permitted by law, Panel 9 Music shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Service.
Panel 9 Music’s total liability for any claim relating to the Service shall not exceed the amount paid by the user to Panel 9 Music during the twelve (12) months preceding the claim.
13. Termination
Panel 9 Music may suspend or terminate access to the Service at any time for violations of these Terms or misuse of the Service.
Upon termination:
- Access to the Service may immediately end;
- Licensing rights may terminate;
- Users must cease use of Panel 9 Music content except where expressly permitted in writing.
14. Changes to These Terms
Panel 9 Music may update these Terms from time to time.
Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and interpreted under the laws of the applicable jurisdiction selected by Panel 9 Music, without regard to conflict of law principles.
